Registered Office (Registered Address)
A Company shall, from the day on which it begin to commence its business, or within 14 days after the date of company registration, whichever is earlier, have its registered office situated in Malaysia. (Section 119 of the Companies Act 1965)
Every company shall inform SSM the location of its registered office within Malaysia by submitting the Form 44 to SSM.
All statutory books & records are required to be kept at the company’s registered office.
Most of the Sdn Bhd companies (almost all) in Malaysia will normally have their registered offices set at the company secretary‘s office to fulfill the requirement of Section 139(3) where at least one of the secretaries shall be present at the registered office of the company by himself or his agent or clerk.
Registered office is NOT your business office.
You can decide your business office address at any place in Malaysia, be at your home, shop, factory or even you don’t need to have one, as this is not required by SSM at the time of company registration!
